“And I will Restore thy Judges as at the First…”

Legal ForumOn Sunday July 26 we commemorate a day with national and traumatic significance: the 9th of Av, a day which signifies the destruction of the land of Israel.

Ten years ago 8,000 Jews were expelled from their homes and a flourishing region was destroyed and turned into a terrorist base, in a haphazard and senseless move which was one of the grimmest events to take place in the State of Israel.

Former Prime Minister Ariel Sharon assured the Israeli public that “the purpose of this plan is to lead to a better political, economic, demographic and security reality”. Sharon selected a day which signifies the destruction of the Temple and a day of calamity and disaster in the history of the Jewish people as the day to carry out this plan.

In the years immediately after the expulsion from Gush Katif and Northern Samaria we witnessed the disastrous ramifications of these events. On a personal level families were destroyed, productive individuals became unwillingly unemployed, and home owners became homeless. On a national level the results were catastrophic: Israel’s power of deterrence was significantly diminished, which led to a serious escalation in Israel’s security and the beginning of the Second Lebanon War, as well as the Protective Edge and Cast Lead military operations in Gaza.

The Legal Forum for Israel was established in order to protect the rights of the residents of Gush Katif and Northern Samaria and to minimize the damage caused by this move. The Forum forewarned the Members of Knesset, the government and the Supreme Court of the dangers the new reality would bring about. The Forum perceived that the legal system failed in its role and ignored evidence and predictions presented, which later turned out to be accurate.

For the last ten years the Legal Forum has consistently acted to better the legal system by embedding Zionist values and increasing transparency. Following the precedent of parliamentary and legal activities of the Legal Forum, other Zionist organizations were established, all acting to strengthen the Zionist identity of Israel.

On the Shabbat prior to the 9th of Av we read the opening chapter of the Book of Isaiah. This chapter is very harsh, and implies Israel’s central sin which caused the Jewish people to go into exile and the amendment needed in order for the people of Israel to live in the land: “Zion shall be redeemed with justice and they that return of her with righteousness”. Am Israel deserves to dwell in its land only when its legal system is a just one.

On Wednesday July 22 the Knesset appointed its representatives to the Judicial Appointment Committee and the Committee for the Appointment of Dayanim. We are pleased that the representatives from both the coalition and the opposition are individuals with strong Zionist values, and we believe that the Legal Forum will be able to assist them in selecting the worthiest judges which will benefit the State of Israel.

As we approach the 9th of Av, the Legal Forum for Israel wishes all our friends and supporters that together we will continue the strengthen the State of Israel as a Zionist state with a legal system that will be “a light onto the nations”.

    Most the Texas gentiles I spoke with at the thought the Israeli had gone “mad” to allow Gaza to revert back to the Palestinians. They had the utmost sympathy for the settlers.

  4. The Kibbutzim in Northern Gaza were on land bought by Jews in the 1930s. Also it was pure military folly to have the IDF leave Gaza.

    I and many others predicted at the time all the terroism that would come from Gaza if the IDF left.

    We had a choice it was to destroy Hamas. Then Sharon sold out the country to change the subject (due to the problems of him and his sons) at the urging by his lawyer Dov Weissglass.

  5. I was very much against the disengagement until the end of the debate at which time I supported a partial disengagement with caveats.
    1) I wanted Israel to retain the northern 5 miles of Gaza where all the settlements were because there was no reason to give up all the land and I wanted to break the precedent of 100% withdrawal. I was happy to get rid of the remaining 80% of the land where all the Arabs lived.
    2) I wanted Israel to be in charge of the border crossings. Rice forced Israel into the Rafah Agreement which removed this power from us.
    Whether it was 1701 or this agreement they never got enforced and so we were conned into concessions in exchange for false promises. Just like our guarantees for open waterways and for the UN forces to keep the peace in Nasser’s days. Never rely on International guarantees.

  6. Defense Minister Moshe Ya’alon considered quitting his post as IDF chief of staff to protest the decision to withdraw from the Gaza Strip.

    However, he decided against it because he realized that his resignation would not help and he would be dubbed Israel’s “first conscientious objector,” Ya’alon said at an event in Jerusalem on Monday marking the 10-year anniversary of the disengagement.

    Then-defense minister Shaul Mofaz decided six months before the disengagement to replace Ya’alon as chief of staff with then-IAF commander Dan Halutz, who supported it

  8. The secret of the disengagement from Gaza

    Sharon was not the one who initiated the disengagement. His bureau chief, attorney Dov Weissglass, broached the subject with Sharon, setting the plan in motion with the international community, the Israeli political sphere and Sharon’s closest advisers, including his two sons Gilad and Omri. Weissglass was the first to convince Sharon to go ahead with the disengagement………

    Moshe Ya’alon was the IDF chief of staff. He took an active part in preparing and planning for the evacuation. But after his retirement from the IDF, in his book, he came out sharply against Sharon and his “true” motives.

    President Reuven Rivlin, then a Likud MK,….”the days of the decision on the plan were times of great personal distress for him. He made his personal considerations, and you can fill in the rest. I would suggest looking into what preceded his decision on the disengagement.”
    “I suppose that historians won’t have a very hard time figuring out this mystery,” he said………

    On the eve of the declaration of the disengagement plan, Sharon and his two sons were facing three criminal investigations.
