The soldier under fire in last month’s Hebron incident acted against the laws and values that bind and strengthen Israeli society, Defense Minister Moshe Ya’alon said on Tuesday, as he spoke with high school students in the Jordan Valley settlement of Ma’aleh Ephraim.
“Those who back the soldier don’t back our laws and values,” Ya’alon said.
He spoke with the students on the same day that a military hearing was held about the detention of the soldier who on March 24, fired the fatal shot at an already wounded Palestinian assailant.
“It’s important for us to both win and remain humane,” Ya’alon said and added, “if we lose our morality we will lose our way.”
He spoke against the demonstrations in support of the soldier and warned that the subject could be easily manipulated for harmful ends.
Ya’alon condemned the soldier’s actions, but stopped short of calling him a murderer.
“No one is calling him a murderer.
This is a soldier who did not act as he was suppose to,” Ya’alon said. The IDF prosecution intends to charge him with manslaughter.
The soldiers actions that March day were filmed by a B’tselem volunteer and widely circulated in the media and on Youtube.
“But even before anyone saw the video his commanders saw that his actions were improper and began an investigation,” Ya’alon said.
The term “murder” was introduced into the situation only after the legal proceedings against the soldier began, Ya’alon said.
Still, he said, when one talks about the ethic of “kill or be killed” one should also speak about “do not murder.”
With regard to the larger Israeli- Palestinian conflict, he said, that there was no partner on the Palestinian side because no one is willing to recognize that Israel is the homeland of the Jews.
“That is the source of the conflict,” he said.
Ya’alon added that he did not believe it was resolvable at this time.
“We as modern Western people, have the mistaken idea that there is a solution to everything. Sure, we made it to the moon which gives us the idea that everything is possible,” Ya’alon said.
“I contend that not every problem is solvable, not in mathematics and not in medicine. Even in our personal lives, we live with problems that we manage but cannot solve.
Only when it comes to the Israeli- Palestinian conflict do we insist that there must be a solution.
“And if there is a solution, why can’t it happen now. That is dangerous, God has solutions, but we don’t. We live in the world of instantaneous solutions. If you are hungry, you can go into a fast food restaurant. At home you can put food in the microwave. Just like we want food now, we want democracy for the Arab world now, we want peace now, there are those who want the Messiah now.
“I suggest that we be cautious against these intellectual hurdles, he said.
One has to wonder that if the solution to the Israeli-Palestinian conflict is so well-known, why has no one made it happen over the last one hundred years, he said.
“I don’t think time is working against us,” he said.
Separately, he spoke about the importance of doing a better job of integrating Israeli-Arabs into society.
Later while still in the Jordan Valley, Ya’alon spoke in support of the settlements there and said that the region had an important role to play in the nation’s future.

Yaalons biggest piece of evidence appears to be a lie, were they words put in the IDF mouth by Yaalon when he declared the soldier guilty before his subordinate military officers began their investigation.
In other words there is no doubt that the soldier beleived he had explosives and Yaalon’s stooges lied on the public de facto orders of Yaalon to find the soldier guilty prior to the beginning of investigation.
He did the same at Duma, proclaimed to the public that Jews burned a baby and now we see after Yaalon stalked and incarcerated Jews falsely that there have been 2 more arsons AND the witness caught guilty of lying about jewish attacks.

Administrative Detention Weakens Israeli Democracy so we must remove it from our tool-box in fighting Arab Terror. It’s counter productive and now used against it’s original intent to deter Arab terror but now and for some time being used politically and physically to persecute Jews.
Israel maintains a perpetual state of emergency as a political tool to provide the legal rationale, however twisted, for the policy of continuing administrative detention.
Israel has stitched together a complex system of various emergency measures borrowed from the British mandate era, Jordanian rule over the territories, and its own military and civilian laws, while making no effort for nearly seven decades to unify these legal procedures.
Successive Israeli governments maintained this hodgepodge administrative detention system to give it the flexibility to resort to one set of rules or another to enforce detention under the guise of legality.
Admin detention has been maintained primarily as a tool against Arab unrest and terror where there is no proof of wrong doing but mostly where intentions are believed clear to those upholding and enforcing national security. It’s use against nationalist motivated Jewish activists goes against the intent of these regulations and has become a very dangerous practice to those who advocate civil rights and democracy and the rule of law.
The Israeli government has cut the rug out from their justification for maintaining the regulations that allow administrative detention when it is used as a political tool to persecute Jews who pose no threat to national security which is the case with Ettinger and many before him over the years…. That he is part of the Kahane family seems to be reason enough for our stupid never have a clue anti Jewish clique of police, Shin Bet,State Prosecutors and courts…
They are all corrupt, all against Jewish nationalism. For these protectors of their kind of Israel, nothing is sacrosanct like human rights, civil rights and democratic principles of jurisprudence. Nothing will deter their visceral hatred if not fear of ideologically and religiously motivated young Jews who are viewed by them as being more dangerous to their vision of the state than are Arab terrorists.
Anyone who is familiar with Israel’s state of being from the day of its inception to the present cannot deny the fact that the country has legitimate national security concerns. But when national security becomes a political tool It should be reviewed and abolished.
Palestinian lawyer Mohamed Allan, who went on a hunger strike for 65 days to protest his indefinite detention in Israeli custody, was subsequently moved into medical care and had his detention suspended in August over fears that he might die in prison — potentially provoking massive Palestinian unrest. I think that the fear of provoking widespread Pali unrest in that case won his release from admin detention.
There is a lesson here for Jews. Let’s get rid of Admin detention as it is besides being draconian and ineffective in deterring terror it is also undemocratic and being used by unscrupulous state interests in persecuting Jews (Yamit82)

Not true, like any other criminal he is worried about being exposed for his crimes and continues to pressure his military subordinates and the public into beleiving his ludicrous narrative. His crimes were to use his office as Commander of all those who investigate and prosecute in the military who follow his orders to declare the guilt of a suspect not yet investigated… his public declaration was a de facto order by a military commander to his subordinates to obstruct due process for the soldier and find a conclusion of guilt. the man has no shame, but that should not prevent Israelis from demanding an investigation of his abuse of power and authority and an indictment. Meanwhile he still roams free to obstruct justice and disallowing a free justice process for the soldier. Yaalon should be put into detention and held incommunicado to prevent his continuing obstruction of Justice…. everywhere he roams spreading his slanders of the soldier in an effort to prevent and obstruct Justice. Really, Mr. Yaalon? and what Jury determined that the soldier broke either the laws or values? It appears that the one breaking the laws and values are Mr. Yaalon himself:
1-Interfering with a potential criminal investigation by declaring a suspect guilty is contrary to ALL global standards and values of leadership aside from being a criminal offense.
2-Publicly declaring to his military subordinates who are conducting an investigation, an indictment and possible trial that they are to find the soldier guilty is tantamount to giving those same subordinates military orders to find him guilty.
3-Repeatedly declaring publicly the guilt of the soldier even once again to these high school students by stating that anyone who believes in the innocence of the soldier is an outcast.
4- Abusing his power and authority to obstruct due process for a suspect by celaring him guilty before an investigation commences.
5- demonstrating with his repeated attempts that his criminal actions are willfull and not borne of negligence or incompetence which in most courts requires special damages and more severe punishment.
Yaalon has broken all standards of law, values and leadership in his continuing, repeated, relentless declarations of the soldiers guilt and he should be indicted in a criminal court.
since when is it a value or law of any nation that a suspect should be guilty before investigation, indictment or trial? Since when is it a law or value that top leadership should interfere in the due process of law by indirectly commanding his military subordinates towards a guilty verdict before investigation commences?
Perhaps Mr. Yaalon those who back due process of law without interference of political leaders are in fact the true laws and values of Israel. Perhaps those supporting the right of the soldier to due process recognize that Yaalons behavior stinks of corruption and that no one deserves to be declared guilty by the PM and DM prior to an investigation.
The fact that yaalon continues to double down on his unethical and criminal behavior shows that he has no remorse for his obstructing the soldiers due process.
In times of shock, or stress, individuals often do things that they may later regret. If for example, you were in a car accident, were not injured and then, while waiting for the police or ambulances to come, how would you react? Would be calm? Would you be level-headed.
Suppose, with all the Radio, TV and newspapers, you have been hearing about suicide bombers, hidden guns in the clothes of an assailant, or whatever, how would you react if the person on the ground was moving and groaning?
How difficult is it to understand that if one is prepared to offer death, one must be prepared to accept death?
