High court to state: Why haven’t you destroyed terrorists’ homes

Judges order the state to submit details of all demolition orders approved since 2013 by Monday to determine why the houses were not destroyed.

The judges of the High Court of Justice issued an order on Thursday, calling on state officials to submit details of house demolition orders which were approved by the court, yet not immediately carried out – by Monday morning.

The state was asked to submit details on all demolition orders that were reject by the High Court dating back to 2013. The requested details include the dates of the judgments, the dates of the actual implementation of the demolition orders, and the reasons for the timing of the implementation of the orders.

The High Court’s decision harshly criticized the state’s conduct, and actually prevents the demolition of terrorists’ homes until at least November 5. Within the framework of the announcement, judges Miriam Naor, Hanan Meltzer, and Noam Solbar requested that the state attach a breakdown of all demolition orders approved by the High Court since 2013 that were not immediately carried out after a verdict was handed down.

Juidge Hanan Meltzer harshly criticized the state’s conduct surrounding the issue on Thursday. “First of all you say it’s urgent and put the whole system under pressure, and then once the judgment is made, you linger,” the Judge asked the prosecution’s representative Avinoam Segal. “Bring us a list stating when the event occurred, when the judgment was given and when you carried it out. There were cases where things were confirmed and you lingered for months to implement the decision. In the end they say that the courts delay things.”

Judge Noam Sulberg also raised criticism over the delays. “There are cases in which the verdict is handed down, and plenty of time passes until its execution,” he said. “It has a negative effect on the stated urgency. A verdict is given then many months pass,” he added.

“We are in a situation in which attacks come one after the other,” the prosecution’s representative said. “In such an extreme situation, extraordinary tools must be used. The state knows that this process is exceptional. This tool can help deter potential attackers,” he concluded.

Concurrently, the state will issue letters to the families of three of the suspects in the murder of Eitam and Naama Henkin. The appellants can respond to the prosecution’s letter until the November 5 at 10AM. Thus meaning that the demolition orders for those homes will not be enacted until that date –as long as the order remains.

    Apparently some bears are still failing to unesrtan… that is time to start hibernation… permanent if at all possible. 🙂
    There are quite a few demolitions to be effected and my guess is that Jewish homes or places of work will not be involved.

    this headline is incorrect… they are not asking why terrorists homes aren’t being demolished, in fact this request is used as an excuse to delay demolition of terrorists homes. What they are asking is why the demolitions of Jewish homes are delayed….. in other words they are upset that jewish homes were not quickly demolished.

  4. As anyone normal may have expected two news items emerged over Shabbat. Naturally, being part of Netanyahu’s SOP, both gruesome betrayals.
    A. In spite of formal decision to not return them, the bodies of some sources say, nine Islamic terrorists were returned to abu mazen by netahyahu.
    B. Lapid reports that Netanyahu offered him all the postings held by Jewish Home in the “coalition”.

    I am sure Netanyahu never betrayed before or will betray again.

  5. This is interesting but these judges think they are the Bosses of the Knesset and the people. I like an independent judiciary that enforces laws passes by the Knesset. These judges think they make law and the Knesset reports to them.

    does the court request of past orders include the demolitions of Jewish pioneering settlers whose homes they sought to demolish or just the homes of the anti semite terrorists. For me there is a difference, but I understand that for the leftist high court these folks are the same.
    so, the question is whether the court obuscates their own anti jewish behavior or whether BB obfuscates his own anti jewish behavior, or are they on the same team blaming each other like 2 caught criminals?

  7. For once, the High Court pointed out its not dragging out approvals of the demolition of terrorist homes, its the government that has refused to carry them out.

    The blame here rests with Netanyahu not with the High Court.
