T. Belman. Since posting this a Judge extended Ettinger’s detention for another 4 months. This is an outrage. Arab MK’s are far more dangerous to the state and also want to destroy it. Why are they not also in detention for one year? Why?
T. Belman. Curtailment of liberties in times of civil unrest or threats to national security is common in all countries. But the extent is hotly debated. For instance the when the the Patriot Act in the US in the wake of 9-11 its terms were hotly debated, with the Left staunchly in support of liberties and the Right favouring security.
The Left in Israel is dedicated to fighting for liberties also, except it has no quarrel with Administrative Detention of Jews, that violates many liberties. The Israeli Right on the other hand waxes eloquent on behalf of security but is outraged over such detention. As they say, it depends on whose ox is being gored.
A the core of these differences is whether one believes that Administrative Detention must be applied equally to citizens and non-citizens or equally to Arabs and to Jews.
I do not support Administrative Detention of the Hilltop Youths including Meir Ettinger but I do support its use against Arabs. I make this distinction easily because I think the Arabs who align with the Arab cause are an existential threat to Israel whereas the hand full of Jewish youths who are attracted to Ettinger’s ideas, present no national threat at all.
There is no question that people were murdered in Duma. Let us assume for a moment that Jews were responsible. As you know all societies are plagued with murders. Yet in the search for the murderers, western societies maintain all the civil liberties. They do not suspend them to catch and convict the murderers. Nor do they torture them to get evidence or confessions. Even if the murders are “heinous” murders.
In short, I see no justification for suspending the liberties of Meir Ettinger or other Hilltop Youths. They are not a threat to the Nation. And this applies whether any of them are suspected of killing an Arab or a Jew. In the case of Ettinger he is not suspected of killing anyone.
As long as the Arabs present a danger to our National rights or existence, I think Administrative Detention should be applied to them.
Administrative detention can be renewed forever.

My grandson is in danger
The imprisonment of my grandson Meir Ettinger brings back difficult memories for me. I don’t know how many people remember that my late husband Rabbi Meir Kahane, zt”l was jailed under those same despicable administrative detention orders in May 1980.
An administrative detention order deprives a person of his basic rights. He can be held for six months without being charged or tried and the order can be renewed indefinitely.
If there were any evidence that my grandson Meir committed a crime, he should be put on trial in an open court. He has not been tried in court because he has not committed any crime.
What he has done is not considered a crime in any democratic country. He expressed unpopular views in a blog he wrote on the Hebrew website “Hakol Hayehudi.” Simply put, the powers-that-be don’t like the way he thinks.
When his case came to court for review after his first three months in prison, the judge ordered his imprisonment continued. The reason he gave was that Meir had not changed his views. The Honenu lawyer said, “If the judge wants him to change his opinions, he can send him to Korea, there they know how to make people change their opinions.”
The administrative order imprisoning Meir can be renewed by the simple signature of the Minister of Defense for another six months, and another and another – life imprisonment by installments.

With two weeks left of the six months decreed by the Minister of Defense Yaalon, my grandson Meir began a hunger strike on Wednesday, January 20. I hope and pray it will succeed in touching the hearts of the powers that be, but I am concerned about the harm to his health

Surprizing that no one mentions that a basic reason for the establishment of The International Criminal Court in the Hague was to protect people from the ravages and abuses of their own governments ….. Can one imagine a Bibi or a Ya’alon, etc., being mentioned as being on the wrong end of even such an investigation for criminal violations ….. What then will become of their infamous “sacrifies for peace”, their kidnapping and torture of Jewish kids, supposedly legally of course – until goyim step in to teach them better? Ettinger is kept in jail because they lied and their lie is the cause of all the revenge stabbings… they refuse to take responsibility for their role in the murder of Jews. They must either convict ettinger in a fake kangaroo court or they must find a way to release him without harming their own status and being exposed to all as liars. Liars tend to keep up their charade. I cannot believe that those who invented the dancing wedding jews “dangerous” conspiracies have a decent bone in their body.

TED, Basically I agree with you that the Arabs are enemy aliens who want to destroy the Jewish State. So I believe administrative detention in the manner it is applied currently is an effective tool and needed tool to keep Jews from being murdered and keep the state safe.
It is possible that the hilltop youth could be danger to the state, provided they started enough anarchy and battles with the Arabs that would not be controllable. I am not sure that this the case. However, several people in the government I respect with their inside knowledge (such as Bennett & Shaked) have said it is.
That said this administrative detention of Jews could ignite a war between brothers because of its extreme measures. So I say we should err on the side of liberties of the Jews and only in case were the Shin Bet or Police can take hard evidence to a judge of a plot to overthrow the government can administrative detention be used. This however is what the government now claims about Meir Ettinger and his hilltop buddies. That said I am now going to nearly contradict myself for the second time and say this should be chargeable evidence (sufficient evidence to indict) but can not be used because it would endanger the sources (undercover operatives or their informants). Only then should a judge grant administrative against a Jew.
Israel uses administrative detention against Arab terrorists regularly because it allows us to stop the terrorists and does not expose the Arab informants or uncover handlers of those informants. When we arrest these Arabs they normally will provide more information on their accomplices. This is a cycle that continues.
Even though Israel is suffering from a knifing, car ramming intifada among a small amount of Arabs it pales in damage to what happen in the early 2000s with regular suicide bombings.
So far Hamas, Fatah and other terrorist groups have not been able to cause more damage because of; administrative detention, the wall and many Palestinians are deterred because of the dead and wounded they suffered in the early 2000s during the second intifada.
