I Accuse: The Military Advocate General’s Corps (MAG) allegedly neutered the Air Force on October 7. Why has the functioning of the Military Prosecution during the massacre not been investigated?

Today it is clear, from the unbelievable testimony of Amir Bar-Shalom in the video, along with countless testimonies presented below: the MAG neutered the Air Force during the massacre. Every unit and branch of the IDF is being investigated — except the Military Prosecution?

Here is the evidence:

  1. The unbelievable testimony of Amir Bar-Shalom:
    “I was sitting in the war room of an attacking division. At the table where I sat, there was an intelligence officer, an operations officer, and a legal advisor who signed a ‘target sheet’. Meaning: the operations officer says, ‘I want to strike this house’, the legal advisor says, ‘Explain it to me’ — in professional jargon, ‘criminalize it for me’ — and only then he signs.”

    Meaning: a bomb does not fall even in Gaza — all the more so in Israel — without the signature of a legal advisor. Yes, yes.
    Again: a bomb does not fall even in Gaza — all the more so in Israel — if there is no legal advisor’s approval.

  2. From the MAG’s interview in Globes under the headline: “The major general who decides which Hamas targets the IDF is allowed to attack.” The article proudly reviewed the MAG’s activities on [October 7], stating that “within hours, around 100 of her subordinates — regular and reserve lawyers — were already positioned at all key combat points: from commands and divisions, through the Air Force and Navy, and all the way to Operations and Intelligence directorates. Turns out, legal experts are an operational resource no less in demand than tanks.”
    And any additional word — unnecessary.

  3. This is how it looked in real time: see in the response to the post three more videos, two of them from real time:

    The first video — revealed by @AyalaHasson — is from the helicopter Brig. Gen. Oren Solomon communicated with; a gunship was sent to the Nova festival in real time — on the morning of the massacre. For half an hour the helicopter circled in the air, located the terrorists’ pickup trucks, but “was not sufficiently certain,” and simply turned back without doing anything!

    Recall that journalists who received the information contacted the IDF, which denied the story for many long months — only later was the video exposed by Ayala Hasson. Why did the IDF feel the need to deny?

  4. The second video — real time: terrorists are seen with an RPG, and the Air Force’s order is not to fire. Why not fire? Why???

  5. The third video: Yair Avital, a member of the emergency squad in Be’eri, recounts a helicopter that aimed at a concentration of 50 terrorists in Be’eri, yet did not receive authorization to fire. This was at noon!!

  6. A report — perhaps the most detailed — in Israel Hayom, quoting the Air Force’s own investigation, states:
    “At 10:30, the command center said: ‘Enough, strike anything in the fence area, without criminalization,’” says a person who was present that day.

    It is important here to explain the ‘criminalization’ procedure. The ability of fighter pilots and UAV operators to identify from the air whether those on the ground are terrorists, civilians, or hostages is extremely limited. Therefore they normally rely on guidance from ground forces. But in many cases, there was no one to guide the pilots, and they remained confused, hesitating for long periods whether to strike or not.”

    “Despite this inherent difficulty, one of the conclusions of the Air Force investigation is that for far too long, pilots in the field continued to adhere to standard procedures and the chain of approvals used in the Air Force, and did not understand on their own that they had to shift to a far more permissive fire policy. When presenting the investigation before various Air Force forums, the phrase ‘over-obedience’ was even used to describe pilots’ conduct in the first hours.”

    “‘What can you do? The Air Force is a corps of slowpokes,’ says a former senior official. ‘Until approval goes through the entire command chain according to regulations, no one fires. It’s part of the organizational culture.’”

    Notice the term “criminalization” quoted here? This is exactly the “criminalization” Amir Bar-Shalom spoke about in the video. As long as no ‘criminalization’ was performed — the legal advisor would not sign off on the strike. And who will strike without legal authorization?

    And it continues: “The strike map of the morning and noon hours tells a horrifying story: Air Force bombings trace the Gaza border fence, cling to the paths crossing eastward out of Gaza toward Israel, and circle almost all the communities and bases in the sector. Some bombings are marked as having fallen inside the bases and communities themselves. According to the investigation’s data, 81% of the strikes that day were on the fence line, 12% near communities, and 6% inside bases. Another 1% inside civilian communities.” End quote.

    Since most activity near the communities occurred in the afternoon hours, we learn that in the morning hours the strikes inside communities were effectively zero.

  7. This report joins a Channel 13 report stating:
    At 07:15, Air Force Commander Maj. Gen. Tomer Bar arrived at the command bunker, declared a state of war, and ordered “maximum force in the air” and allowed forces to use fire in a permissive and decentralized manner.

    At 08:30, the Air Force Commander realized his orders were not being carried out, spoke with squadron commanders, and instructed them not to wait for directives from Air Force HQ but to act independently based on developments in the field.” End quote.

    What? At 08:30 on the morning of a war, the Air Force Commander’s orders are not being carried out? Air Force HQ is not implementing them?

    Recall here a July ’23 report about refusal in the Air Force, including “two senior officers who resigned earlier today: the former head of Hatzerim base, Brig. Gen. Sheli Gutman, and former head of the Air Wing, Brig. Gen. Amnon Ein-Dar. These are two of the most senior figures who manage the Air Force’s central command bunker during wartime.” Is this refusal? Or MAG directives? Or both?

  8. The Zman Emet investigation from 11/9/24 also had to note that “in the event’s early hours, the bunker and cockpit repeatedly adhered to procedures requiring a formal, lengthy approval process for firing inside Israeli territory. This led to problematic situations.”

  9. Also, the YNET project “The Day That Changed Our Lives”, which includes thousands of bulletins, internal communications, and Red Mail messages throughout October 7 — elaborates on strikes in Gaza or on the fence, but knows to mention only one single strike inside Israel before noon.

  10. Likewise — a report by @yoavzitun in YNET, quoting the Air Force investigation and detailing Air Force activity by hour and minute, mentions three aerial firing events toward targets within communities before noon.

    And note what happens at 11:27 — “The situation-room officer himself, in a move controversial due to command-and-control issues, activates a Zik UAV to strike terrorists at the Black Arrow memorial.” Meaning: the bunker command is not issuing strike orders inside Israel, and only an officer independently gives such an order. You can surely understand why.

  11. It should be emphasized: Avi Weiss revealed that —

  • Although the Air Force Commander declared war at 07:15 and ordered full-force fire (see above);

  • Although the Head of Operations Directorate declared war that morning;

  • Although Netanyahu himself declared around 08:00 that “we are at war”;
    — despite all this, the MAG and the Attorney General repeatedly informed Netanyahu — while distorting the law — that the war declaration was not valid until Netanyahu convened the government and cabinet, an event that could only take place on Saturday night, after Simchat Torah, and which retroactively approved the actions.

Why?

  1. So the war was run by Jewish lawyers?

    Sorry, hate to say it, but that’s funny – except the criminal consequences of utter stupidity.

    No wonder the Israeli judicial system is the most crooked and useless in the entire developed world.

  2. This report speaks for itself. There is a tradition of “don’t execute anything unless permitted” and it seems that it reached a climax on Oct 7. Those who lost family members should be lawyering up to sue the government, but be careful NOT to engage any of those who demanded to stand down on Oct 7.

    The MAG force has a lot to answer to and the sooner it gets started, the better.

    To get the ball rolling, those military lawyers should be cross-examined and encouraged to speak out about how they determined the lines of action, all the way to the top. There must have been some officer who told them what to do. If none of them can be persuaded to speak out, they all need to be court-martialed according to the orders they passed out or down. I’m sure when things get serious enough, they’ll be happy to sing.
