Now it’s official: Where was the Air Force on October 7?

Peloni:  We first reported on this story early last year, in which Yossi Baum revealed the startling findings about the trap in which PM Netanyahu found himself caught in the early hours of October 7, while the innocents in the Kibbutzim surrounding Gaza, along with the Nova Music Festival goers, were being slaughtered.  In what has been become a basis for bizarre antisemitic plot lines put forward by sensationalizing podcasters and talking heads, the mystery surrounding Israel’s nearly silent response in the early hours of October 7, which stretched through that terrible day, the reports and deductions put forward by Weiss and Baum led to the revelations that the legal fraternity in Israel held Israel’s political elites in a state of capture, delaying and compromising the possibility of a vigorous and fearsome response to the terrorist attack on October 7.  With PM Netanyahu’s statement on the events of October 7, first revealed to the State Comptroller, and now released to the public, we have eye-witness confirmation from the Prime Minister himself recounting the unbelievable tragedy which was purposefully made worse by the very legal and judicial systems which should have acted to support the gov’ts efforts in protecting the citizens of Israel and defending the nation on October 7.  No greater condemnation than this could be made of the political infighting which betrayed the nation that day, just as no greater statement of support for Judicial Reform might be construed from the institutionalized failures which aided the wholesale slaughter of so many, not to mention the more than 250 precious innocent lives who were stolen away into the hell hole terror dens in the tunnels of Gaza during the near paralysis in those precious early hours of October 7.

Notably, this is not likely to be the worst of what will be revealed in the hopefully not too distant future.

In Netanyahu’s document it was officially revealed: despite the fact that Netanyahu declared war in the early morning hours of October 7, the declaration was not implemented until the late night hours (in practice, until October 8).

The reason: the Military Advocate General and the Attorney General claimed — contrary to the law — that Netanyahu supposedly does not have the authority to declare war. As stated in the attached document — Netanyahu announced his intention to declare war at 10:00 in the morning; in addition, he went out to the public at 11:30 and announced in his own voice, “We are at war,” and he determined this again in the cabinet meeting at noon (attached).

However, even this did not help. The legal counsel refused to approve effective strikes because “a government vote is required” — an event that could only take place later, since there were ministers who could not arrive amid all the chaos.

Only in the nighttime hours after the massacre did a government meeting take place in which a vote was held, and afterward a cabinet meeting in which the declaration of war was approved, as was previously revealed for the first time by @Motty53.
It is not superfluous to note that the claims of the legal counsel in this context are completely contrary to the reasonable interpretation of the law.

The practical meaning — in the critical moments of October 7, when our brothers and sisters were being slaughtered, massacred, raped, and burned:

  • It was forbidden to attack inside Israel in places where terrorists had infiltrated. Just for example:

    • At 2:00 p.m., the standby squad in Be’eri begs a helicopter that was on site to eliminate 50 terrorists who had positioned themselves in a garden. It turned back without doing anything.

    • Another helicopter, whose pilot sees terrorists with an RPG and receives an order — in real time — not to strike him.

    • While Brig. Gen. Oren Solomon, while inside the inferno near the Nova party, implores the senior echelon for air support, the helicopter sent toward him circles in the sky for about half an hour, identifies the terrorists, but returns as it came “because there was not sufficient certainty.” The pilots do not fire without the signature of a legal adviser for every target.

  • It was forbidden to attack in Gaza all the places to which senior Hamas figures and operatives fled, such as shelters or hospitals, etc., since these were declared “humanitarian shelters” that are forbidden to be attacked!

  • Even the strikes that did take place in Gaza — were carried out after “roof knocking” throughout that entire cursed day!
    One’s hair should stand on end: our brothers and sisters are being killed, massacred, beheaded — and us? We are bombing empty buildings in Gaza???

  • It was forbidden to attack also in Gaza in places where there are several “uninvolved civilians” — despite a new General Staff directive on the matter that was distributed during the massacre at 13:00 for precisely this purpose!
    In other words: there was no way to strike senior Hamas figures or operatives who were near their family members and/or neighbors!

  • In general, as testified by Alon Ben David, in every bombing of a specific target, the signature of a legal adviser from the Military Advocate General’s Corps was required; without it, no bomb would be guided to any target, with all that this implies.

  • The “Hannibal Procedure” was not activated. Since the kidnappings were carried out in “waves,” that is: the terrorists transferred hostages to Gaza and returned to Israel in order to transfer additional hostages — the non-activation of the procedure enabled the additional waves of kidnappings!

  • The supply of fuel and electricity to Gaza also continued during all those horrific hours, until the passage of a cabinet decision on the night of October 8 to stop the supply!

All of these, with the exception of a few isolated cases, were not carried out — even at the height of the deadliest and most horrific blow suffered by the Jewish people since returning to its land.

In conclusion, it should be noted that this is not only Netanyahu’s determination:

  • The commander of the Air Force declared war already at 7:15 in the morning. However, he himself testifies that his orders were not carried out!!

  • The head of the Operations Directorate declared war at 7:58 in the morning.

  • The commander of the Gaza Division declared war already at 6:45 in the morning.
    — But the Attorney General and the Military Advocate General refused to align with the determinations of the security gatekeepers and did not heed their pleas. There are no words that can describe the horror.

The public demand must be clear: it is inconceivable that out of all branches and units of the IDF — ????? (specifically) the Military Advocate General’s Corps was not investigated regarding its conduct on the Black Sabbath. We must insist on the existence of an effective investigation. Then, and only then, will we begin to understand — where the Air Force really was on October 7.

The article and the comments below indicate that the Military Advocate General and civilian levels of advocacy all worked together to make sure that a lot of damage was caused to Israel; especially those at the Nova Concert and in the towns and villages close to the Gaza Strip. Indeed, they probably stopped interfering in the necessary acts of rescue when they were told that the terrorists intended to do much more damage which might have hurt those lawyers’ behinds too.

    If we are to take Netanyahu’s word for anything of what happened in the first 2 days of this war, the only way to recover from this self-defeating maneuver by the judicial parts of the government is to investigate all of them and to hold those responsible that made every attempt to cause such a great catastrophe to the Israeli people. Those lawyers should be disbarred and then sent to serve in the Gaza Strip for a couple of years with determined commanders watching their every move. They may even get some draft dodgers as companions in the ditches.

    Coming back to the article, the act of refusing the order of the prime minister to defend the country is very likely illegal and thus an act of treason. I have no idea what a suitable punishment for that crime could be in Israel. In “normal” countries, that kind of crime gets a death penalty handed down. It is also time to trust our commanders in the field to accomplish what they were trained for without this degree of judicial interference. The usual quote is that time is money. In this case, it cost lives!

    If by some quirk of the Israeli Basic Laws, it was correct to wait for government approval to declare war after the war had actually started, the law must be changed immediately. Just think: the Iranians fire a nuclear tipped missile into Israel and we are not allowed to destroy it en-route due to lack of judicial approval. We must be better than that!!

  3. Rabbi Weissmandl accused Jewish leadership of undermining efforts to save Jews during the Shoah. I was overwhlemed as I learned this and then to witness the lack of teshuva. And now here we are. Only a full open accounting and self-examination is the path to our salvation.
