Judicial Overreach Threatens the Republic
Peloni: Judicial review is an important concept, but it needs to be tied to established institutional doctrine which the the Founding Fathers of the US, unlike those of Israel, had the good wisdom to enshrine in a single document, ie the US Constitution. The further the US strays from this arrangement, the greater they will be transformed into a nation ruled by a black robed junta. To see how bad things can get, look to Israel today.

Should America’s constitutional republic ever fall, the most likely cause of death will be its corrupt institutions. When citizens lose faith in the “system” and have exhausted all available remedies to “fix” that “system,” they will feel wholly disconnected from the government that rules over them. A cascade of institutional crises will exacerbate public distrust in the “system” until the “system’s” legitimacy collapses.
