Why judicial reform is essential

Like all liberal democracies, Israel needs a strong court and independent judges who will guard the rule of law, good governance, and civil and human rights.

In the past decades, the Supreme Court has empowered itself in a manner that completely violates the balance between government branches. In a series of decisions, the Supreme Court has changed the rules of the game and arrogated for itself jurisdiction which it was not given, some of these being exceptional by international standards. Against the basic concept of rule of law according to which the Court judges according to the rules set by the legislature, the Israeli Supreme Court has designed its own rules, and unilaterally taken unauthorized power, without any public legitimacy. In parallel, the Court has adopted the position that “everything is justiciable”, transforming itself into the sole adjudicator in almost all public and political controversies, large or small. The Court has interfered in issues of foreign policy, security, economic policy, and even who will receive the Israel Prize.

Most criticism of the proposed Israeli judicial reforms has focused on the Israeli Supreme Court’s overreach regarding judicial review of the decision-making of the executive and the legislature. Little has been said about the negative impact of the Court’s HaKol Shafit—everything is judicable—doctrine in other domains.

This doctrine was first applied in the 1990s by then-Chief Justice Aharon Barak. As a result of it, the Court rules annually on some 2,100 petitions regarding every aspect of life in Israel. In fact, the Court often rules on issues best governed by social dynamics—the province of psychology, sociology and political science—not the law. For example, in many aspects of religion in the public sphere.

David, I am certain that had there been a referendum on the issue, the vast majority of Israelis would vote in favor of the reforms. In my mind, a military coup d’etat is taking place now in Israel, when the head of the air force says that readiness has been compromised because reserve pilots refuse to fly. Many are talking about the country falling apart and splitting physically. If it happens, let them take the air force with them, providing they spray these poisonous chemtrails only over their people.

In this column Al-‘Ali criticizes the Israeli policy which, he argues, strives to attain normalization with the Arabs without recognizing the rights of the Palestinian people. He calls on Israel to change this policy and achieve real coexistence with the Palestinians, so as to attain “the hoped-for peace of the brave.” Israel and the U.S., he adds, must realize that there is currently a tremendous and one-time opportunity to achieve genuine peace in the Middle East, thanks to the charismatic personality of Crown Prince Muhammad Bin Salman and his new approach to the development of the region.

The formation of the new government and the dramatic concessions offered by Prime Minister Benjamin Netanyahu to the Haredi parties in his coalition has brought the question of the Haredi, or ultra-Orthodox, economy to the forefront of public debate.

Front-page feature articles in Israeli media over the past two weeks have laid bare troubling economic indicators. Put simply, the Haredi community, which makes up just 12% of Israel’s population, is an epicenter of poverty.

The term “useful idiots” describes those who should know better than to support causes that threaten their natural interests but do so anyway (the phrase was famously applied to western progressives who shilled for the Soviet Union despite its totalitarian contempt for western freedoms). Hanlon’s Razor never assumes ill-intent, while useful idiocy suggests a degree of willfulness; but both presuppose the inevitability of bad acts. Thus, negative conduct is the one constant, whether motivated by animus or ignorance.
