Deri lied, but the court should have shown restraint

If you lie, you have to pay! This is the crux of what the Supreme Court said in its ruling on Wednesday when they struck down Aryeh Deri’s appointment as a cabinet minister.

When he did lie? When he was convicted for the first time in 1999 for bribery and then for the second time in 2022, when he was found guilty of tax evasion. The third lie was the day after the second conviction, which was the most outrageous of all lies: He said that he had never actually meant to pledge to leave elected office when he did just that before the lower court.

Why Israel’s right-wing judges voted against Arye Deri – comment  

T. Belman. I think the Court did the right thing. I see nothing wrong with the law baring Dery, or any other convicted person, from serving as a Minister.  The public has no right to overturn laws by voting. And the Knesset should uphold good laws even when it is not convenient to do so. Dery was convicted twice and lied to the Court. Such a person should not be allowed to serve as a minister.

High Court judges who previously found reasons to rule in favor Benjamin Netanyahu based on ideology, tossed ideology out the window. Why?

It was not surprising that the High Court of Justice’s activist wing nixed Shas leader Arye Deri from remaining a minister within the government following his two convictions.

What was surprising was that moderate conservatives Yitzhak Amit and Yael Wilner and hardcore conservatives Alex Stein and David Mintz ruled against Deri and that even conservative Yosef Elron left the door open to the Election Commission to nix Deri.

The true challenge to Israeli democracy  

The judicial branch has usurped for itself, without consent of the Knesset or the public, supreme powers that do not exist in any other democracy and did not even exist within Israel for decades. Op-ed.

Based upon the reactions of opponents to the new Israeli government and in particular to its proposals for judicial reform, one would think that Israel is sliding into a dictatorship and the abolition of protections for individual liberties.

Such views are expressed by Yohanan Plesner in a recent article published in the Wall Street Journal, in which he derides the government’s proposals to reform the powers of the judiciary. His essential argument is that Israel’s Supreme Court is “the only check on the otherwise absolute power of any parliamentary coalition,” that the Israeli Supreme Court protects “the country’s Basic Laws…broadly recognized as chapters of a constitution in the making” and that the proposed reforms, and in particular the proposed override clause to permit the government to override a Supreme Court decision by legislative action, are fundamental threats to Israeli democracy.

In two weeks, the Israeli government will have to submit its response to the Supreme Court regarding the eviction of the illegal Bedouin outpost of Khan al-Ahmar and MK Danny Danon says the state of Israel must put an eviction date on the table.

“I would like to remind that this is an illegal settlement of Bedouins in the area of Mishor Adumim, where they settled in a criminal way with funding from the European Union, and for a long time there has been a decision to evacuate Khan al-Ahmar that has not been implemented. Therefore, I am calling from here on my friends in the Likud and our partners to give a very brief response to the court: A date. Give an answer with a date for the eviction of Khan al-Ahmar. There is no need to talk too much, no need to start with postponements, this has already been done by left-wing governments in the past,” Danon clarified in an interview with Israel National News.

Despite his conviction, Dery was appointed Health and Interior Minister by Netanyahu, who formed the current Israeli government in late December.<

T. Belman. A few months ago I wrote to two eminent lawyers asking for their opinion as to what would happen if the government did not abide by the Courts decision. I even offered to pay for it. Neither got back to me.

It appears that I saw this coming.

A senior haredi lawmaker warned Wednesday that if Interior Minister Aryeh Deri (Shas) is forced out of the government as a result of a Supreme Court ruling, it would mark the end of the current coalition government.

Welfare Minister Yaakov Margi (Shas) told Reshet Bet Wednesday morning that his party will likely not support the continuation of the Netanyahu government if Prime Minister Benjamin Netanyahu fires Deri.

She overthrew Mubarak, the long standing ruler of Egypt and installed its own regime and attempted to do the same with Syria. She expanded NATO eastward after promising not to do so.. She handcuffed Israel, thereby violating its sovereignty, and demanded she cease settlement construction and back the two state solution.

She  subverted democracy in its own country beginning with the Obama presidency, continuing through the Trump years and now in the Biden/Obama term. Obama pledged to transform America and he did, for the worse.

As long as I can remember, there have been conspiracy theories about organizations bent on “taking over the world” — The John Birch Society…the Council on Foreign Relations…The Trilateral Commission.  After a tour in Vietnam and two subsequent years privy to top-secret information working for the Naval Security Group (a military arm of the NSA) opened my naïve eyes (I had enlisted in the Marine Corps at age 17 to “fight the communists”), I was angry enough that my government had lied to the American people (repeatedly) to spend much of my college study in discovering how they could get away with such a betrayal.  So I spent a lot of my college studies on government, political psychology, and philosophy in an attempt to understand how governments can so easily and often dupe their loyal populations.

Its expulsion of the Jews resulted in the country’s ultimate decline. Jews were central to Germany’s vibrant intellectual, artistic, and economic life in the 18th, 19th and 20th Centuries. Hitler’s evil and irrational hatred not only decimated European Jewry, but it also destroyed Germany, and tens of millions of lives across Europe as well.
